DEFINITIONS
"Oriocenter" means Consorzio Operatori del Centro Commerciale Oriocenter, via Portico 71 - 24050 - Orio al Serio (BG), Italy.
“Site” means the web site www.oriocenter.it owned by Oriocenter
"User" or "You" means any visitor or user of the Site.
"Services" means services and parts of the Site specifically reserved for registered Users.
PRELIMINARY INFORMATION
The present document is providing the General Conditions of Use of the website published at www.oriocenter.it, to which anyone wishing to navigate on the Site should comply.
The access to the Site and every activity that implies the navigation on the corresponding web pages constitutes full acceptance of the General Conditions.
If the User does not intent to accept the General Conditions, he/she must abstain from navigating on the pages of the Site. Everyone accessing the Site implicitly declares that he/she shall not use the Site and all its material for unlawful use or in any case for any use contrary to the applicable laws.
The General Conditions may be modified by Oriocenter, without giving any notice to the Users, which are in any case bound to read the conditions periodically before the access to contents of the Site. The access to the Site after these modifications implies the full and unconditional acceptance of the General Conditions modified in such a way.
Whereas in the pages of the Site are offered products and services or presented contents subject to special terms and conditions as described in such pages, these special conditions will prevail on the present General Conditions.

The User may only use the Site to make legitimate operations and may not use the Site to make any speculative, false or fraudulent operations.
Unless otherwise expressly specified by Oriocenter, any part or section of the Site, the information and the material available in the Site, are for personal and non-commercial use only.
Fraudulent Users will be prosecuted to the fullest extent of the law.
GENERAL LIMITATION OF LIABILITY

IN NO EVENT SHALL ORIOCENTER BE LIABLE FOR EVENTUAL DAMAGE, LOSS, NON-PERFORMANCES CAUSED BY SERVICES OR SECTIONS OF THE SITE NOT DIRECTLY OPERATED BY ITSELF.
In no event shall Oriocenter and its directors, officers, employees, or collaborators, be liable for any injury, loss, claim, damage, or any special, exemplary punitive, incidental or consequential damage of any kind, either based in contract, tort or otherwise, which arises out of or is in any way connected with any use of the Site not in accordance with these terms and conditions, even if Oriocenter has been advised of the possibility of such damage.
If, notwithstanding the above, Oriocenter is found liable for any loss or damage relating to the use of the Site, User accepts and agrees that the liability of Oriocenter shall in no event exceed the User fee (if any) for the use of the Site.

THE HYPERLINK TO THE HOME PAGE OF THIS SITE MAY BE CREATE UPON WRITTEN REQUEST SENT TO ORIOCENTER. ORIOCENTER RESERVES THE RIGHT TO DENY THE AUTHORISATION IN CASE THE LINK, IN ITS SOLE DISCRETION, MAY REPRESENT A DAMAGE FOR ORIOCENTER ITSELF (INCLUDED IMAGE AND REPUTATION DAMAGE).
DEEP LINKING OR FRAMING, MADE TO AVOID THE CONTENT AUTHORSHIP RECOGNITION, ARE EXPRESSLY FORBIDDEN.
REGISTRATION AND SUSPENSION OF SERVICES
To complete the registration procedure, some personal information about the User will be requested.
The User acknowledges and accepts that the his/her personal information will be used and registered by Oriocenter according to the Italian regulation, law n. 675/1996, according to the procedures contained in the notice provided to the User trough the Site.
The User declares that his/her personal information are correct and truthful.
Oriocenter reserves the right to suspend the access to the Services at any time and to cancel the registration of the User in the following cases: a) should the User violate the present conditions or the specific rules regarding the various Services to which he/she has access; (b) should the User utilize the Services for illegal purposes or for the transmission or exchange of material which is illicit, vexatious, slanderous or defamatory, injurious to the privacy of others, or may violate rights of intellectual or industrial property or other rights of third parties, (c) should the User use the Services for any activity not in accordance with these terms and conditions or unlawful. The User assumes all responsibility for the content of the messages, the texts and material sent to the Site or in any case made accessible through the Services or the Site and Oriocenter disclaims any liability for claim for damages and for any damage occurred from claims or legal actions of third parties directly or indirectly resulting from the use of the Services by the User.
SERVICES ACCESS
Access to some Services is permitted through the use of a user ID code and a password chosen by the User.
The User declares that he/she is informed that the knowledge of this data by third parties would allow these third parties to use the Services in his/her name. The User shall therefore guard his ID code and password with the utmost diligence and confidentiality, and he/she shall exonerate and hold Oriocenter harmless from any action, claim or request, including compensation for damages, deriving directly or indirectly from the use or abuse by anyone else of his/her ID code and password. The User shall give Oriocenter prompt notification of the loss or theft of the password and/or user ID by e-mail to xxxxx. The User will therefore be responsible for deeds and/or damages to Oriocenter deriving from the violation of the above obligations.
CANCELLATION
The User has the right to withdraw at any time from the registration service by providing notice of the cancellation to Oriocenter.
The present right of cancellation constitutes an ameliorative condition for the User, if consumer for the law in force, with respect to the provisions of italian law n. 50/92 and n. 185/99.
Within 76 hours from the cancellation notice by the User, Oriocenter will disable the User access to the Services.
PRIVACY PROTECTION
Oriocenter is committed to respecting Users privacy and security. Data that the User will eventually send to Oriocenter through the Site will be processed with maximum attention and by all the instrument necessary for their security, in full accordance with Italian law about privacy protection.
THIRD PARTIES CONTENTS AND SECTIONS
The Site includes sections, articles and in general material managed or supplied by third parties.
Oriocenter has no responsibility for the lawfulness, veracity, accuracy, completeness or any other feature regarding the contents of this material or of the Site sections managed by these third parties.
The accountability for the contents of this material or Site sections, including the ownership and the legitimacy of the use of text, images, photographs, music, clips or everything else, is the exclusive responsibility of the third party cited. Any claims regarding the contents of the material or of the Site sections, managed or supplied by third parties, are to be directed exclusively to the respective authors or provider.
INDICATIONS AND COMPLAINTS
Oriocenter shall, if a sufficiently motivated request is sent by writing or e-mail to Oriocenter, timely remove the material posted on the Site that will result property of parties, different from the material author or the section provider indicated, which may legitimately claim rights or interests in the material or its contents, or should the material or its contents damage any interest or right protected by law, or should the material or its contents infringe the law.

TERMINATION OF USE
ORIOCENTER MAY TERMINATE OR SUSPEND USER ACCESS TO ALL OR PART OF THIS SITE, AT ANY TIME, WITHOUT NOTICE AND IN ITS SOLE DISCRETION.
SEVERABILITY
Any clause heading used herein is for convenience only and shall not in any way affect the interpretation of these terms and conditions.
Should any clause or part of it be held to be invalid because it contravenes any applicable legal provisions, all other terms of any such clause or part of a clause shall remain in full force and effect.
These terms and conditions are compiled in Italian and in English. In whatever case of discordance between the two texts or doubts about their interpretation, the Italian one will prevail.
APPLICABLE LAW AND JURISDICTION
THESE TERMS AND CONDITIONS WILL BE GOVERNED BY AND INTERPRETED IN ACCORDANCE WITH THE LAWS OF ITALY.
